w3c Compiant issue

I'm using Tigra Menu Gold, and have the following code to initiate my menu:

When I try to run a w3c validation on the page, I get the error, "document type does not allow element "table" here". It indicates the line that starts "? '<table cellspacing="0"" above. I realize that this is not really a table element, but that it's building the table using JavaScript. But, I really want my pages to be w3c compliant, so is there any way to fix this problem?
